    Interpretation - Immigration - Legal Referral

    I am Venezuelan by birth and Colombian by naturalization.Ā  I came to the United States in October 2018 with the intention of applying for Political Asylum, since I was the victim of abuse and persecution by the regime that controls my country.Ā When I got here I started looking for legal advice by visiting several attorneys in Los Angeles County. Many of them recommended me the option of Asylum but their divided opinions rather than giving me alternatives filled me with doubts and uncertainties.

    In one occasion, a friend recommended someone who dedicated to filling applications, "supposedly" with permission to do that job. The case was that guided by his recommendation and the attractiveness of the cost for the process, I agreed to do it with that person.

    Immediately, I was asked for my information both to complete the asylum application and to write down my experience of the facts that have occurred to me in Venezuela.Ā  Everything was done under his guidance and his perception. Once it was finished, I received the application only to be signed and sent to immigration.

    Once I took that step, I was contacted by USCIS later on to continue my process and i was during the first interview, that I realized how poorly oriented I was, with the blessing that the officer who I was assigned to my case, gave me a new opportunity and made me a series of recommendations that I had to take very seriously to move forward with my process.

    After that day, I started my search for someone who could really guide me and that was when I coincidentally met Mrs. Maria Empera. She was the one who guided me to get out of such a difficult situation. I spoke to her without any reservation and after reviewing my case, she highly recommended an excellent lawyer in LA.

    Tenant & Landlord LawĀ Ā - Eviction -

    This area of my practice focuses on residential real estate. Landlord-Tenant law involves eviction proceedings in southern California, and also the preparation of various documents and notices that can often help to mitigate the potential for litigations.Ā Ā 

    Our expertise includes, but is not limited to:

    • Go through case files to determine the details regarding property/tenant eviction issues.
    • Ā Obtain information and documentation regarding timely completion of eviction processes.
    • Coordinate with brokers to determine and verify occupancy information, required to complete paperwork. Ā 
    • Draft show-cause hearing documents, and prepare stipulations, and affidavits, for internal and external signatures.
    • Draft personal property notices, and follow up with local counsels regarding hearings and trials.
    • Prepare affidavits and other documents, and gather and analyze research data such as statutes and legal articles.
    • Prepare for trials by organizing exhibits, and filing pleadings with court clerks, in an accurate and timely manner.Ā 
    • Handle screening, intake, provision of technical, and investigative support, and provide legal advice as required.

    Civil Law - Hearing Preparation

    When getting ready for a court hearing,Ā  my duties are to:
    Ā 
    • Organize and maintain case files.Ā Ensure all pleadings, discovery documents, court orders, and correspondence are current, indexed, and accessible—both digitally and in hard copy. Assemble a complete, tabbed trial binder for in-court use.
    • Track deadlines and procedural rules.Ā Monitor all pre-trial and trial-related deadlines, including court-specific requirements.Ā Double-check compliance with local rules regarding exhibit exchange, filings, and courtroom procedures.
    • Coordinate witnesses.Ā Confirm availability and contact information for all facts and expert witnesses. Schedule prep sessions with attorneys and ensure logistical details like travel or video access are arranged.Ā  This includes finding a certified interpreter if the witness does not speak English comfortably.
    • Assist with exhibit preparation.Ā Label and organize all exhibits in trial order. Prepare exhibit lists, confirm admissibility status, and coordinate demonstratives or visual aids needed during trial.
    • Draft supporting documents. Help draft or finalize materials such as witness lists, exhibit lists, subpoenas, and affidavits. Review formatting and citations to ensure compliance with CA Court Rule 1.200.
    • Manage courtroom logistics.Ā Reserve trial technology (e.g., monitors, projectors), prepare a ā€œgo bagā€ with supplies (exhibit stickers, stationery, chargers), and confirm any special courtroom access or delivery needs.
    • Provide trial-day support.Ā Be ready to assist in real time—whether it’s retrieving documents, updating outlines, tracking objections, or supporting last-minute filings. Stay aligned with the attorney’s courtroom strategy and communication needs.

    • Representing the best interests of the student in the educational process.

    • Solidifying our working-knowledge of State and Federal laws pertaining to children with special needs. Therefore, we can inform parent/guardians of their rights. If need arises, we will research a specific legal issue or case that is pertinent to a child’s education program.

      After our 30 minutes free Q & A, if our advocacy services are right for your child, the intake process start. We will put together an advocay package base on the case's needs.

      Fill out the Client Intake Form

      Our team will assess the needs of your child. If additional documentation, such old IEPs, assessment results, progress reports, letter from District, Report cards, Tri-Annual Evaluations, etc. are needed, we will contact you.

      After reviewing these documents, we will start to training you on the IEP’s process, in collaboration with Yo Domino Mi IEP, and create a timeline plan, of the process for your child's IEP.

      Resolving an Eviction - Mediation

      The unlawful detainer process, more commonly known as an eviction, is used when a landlord wants to remove tenants from a rental property. Only a sheriff can evict someone with a Court Order.

      Regardless of the issue the landlord and tenant may have, the landlord cannot evict the tenant, lock doors, or remove his belongings. The landlord must obtain a court order for the sheriff to evict the tenant.

      Please read the law "California Civil Code Section 1946.2" before you start or respond to an eviction case.

      Call CA Secretary of State if you are a VICTIM of your landlord filing a false declaration to evict you.

      EVICTION LEGAL MOTIONS

      TO PETITION OR TO RESPONSE

      If something is legally wrong with what's in the Complaint or the process, the defendant can ask the court to cancel all or part of the case.

      DemurrerĀ 

      • Your tenant may file a Demurrer to argueĀ that your Complaint doesn’t include all the facts or legal requirements to prove theyĀ should be evicted.
      • A Demurrer can delay the case for a few weeks.
      • If the tenant wins, you may need to start the case over or serve a new notice.

      Motion to Quash:Ā 

      • Your tenant may file a Motion to Quash Service if they think you didn’t serve the Summons and Complaint to them properly.
      • If the tenant wins, you’ll need to re-serve the forms.
      • If you win, the tenant must quickly file an answer.

      Motion to set aside the default judgment.Ā 

      If a defendant does not respond to a civil lawsuit, the plaintiff may obtain a default judgment, winning the case without the defendant’s participation. This motion can be filed if the defendant has a valid reason for not responding, such as never being notified, etc

      Ex Parte Stay of Execution.

      If you, the defendant, lose the eviction case, you need to move out (at the latest) 5 days after the sheriff posts a Notice to Vacate on your door. If you need more time to move, you can file an Ā You will need to show the court that you have a good reason for needing more time.

      What is Mediation?

      Mediation is a structured negotiation process in which an independent and neutral person, known as a mediator, assists the parties in identifying, evaluating options and negotiating an agreement to resolve their dispute. (See CaliforniaĀ  Rule 3.857. Quality of the mediation process) Mediation is an alternative to a judge imposing a decision on the parties.Ā  Courts encourage mediation, and although the process is voluntary,Ā  it’s important to know that refusing a request to mediate may weaken your position if the case is taken before a judge later.

      The mediator does not have to be an attorney.Ā  Ā The process is informal and flexible, attorneys are not necessary. No formal rules of evidence or witnesses.Ā  It is 100% confidential.

      Ā What are the benefits of mediation?

      • Effective – Mediation has grown in popularity because of its high settlement rate.
      • Efficient – Disputes can be resolved faster than going to court. Statistics indicate that more than 70% of mediation cases settle on the day or shortly thereafter.
      • Cost-effective – Resolving a dispute through mediation is much less expensive than going to court.
      • Confidential – Mediation allows the dispute to remain private and can also be less disruptive to a business or a family.
      • Flexible – Parties work with a specialist mediator to explore the dispute and all the possible solutions together.
      • Less formal than going to court – Fewer people are involved in mediation than when you go to court.

      Process serving in California is the legal method of delivering court papers to involved parties, requiring a neutral person (18+) to officially notify them of a lawsuit or legal action, often done by professionals who must register and follow strict rules for proper notification, ensuring due process, with methods likeĀ personal delivery,Ā substituted serviceĀ (leaving with another adult + mailing), andĀ service by mailĀ used, all documented on aĀ Proof of Service filed with the court.

      Can you serve papers yourself in California?

      Do not serve the papers yourself!Ā  Any personĀ at least 18 years old andĀ not a party to the case may serve papers.Ā The person who serves the documents will have to fill out a Proof of Service ( POS) form showing what they gave (served) the Court documents to the other parties.Ā  This has to be filed at the Court to prove that you serve the other party.
